Privacy information notice for application Telepass Truck

pursuant to Articles 13 and 14, Regulation (EU) 2016/679 (“GDPR”)

With this information notice, Telepass S.p.A. wishes to explain the purposes of treatment of your data related to the use of the Mobile Application Telepass Truck (“App”).

Normally the use of the APP does not involve processing of personal data pursuant to the GDPR, insofar as the APP provides data referring to information regarding companies and means of transport. Nevertheless, whenever it is possible to derive information related to a physical person from this data, that which is specified below is still valid.

Telepass S.p.A., with a registered legal office in Via Laurentina, 449, Roma, in the person of its pro tempore legal representative, is the data controller of the processing of your personal data (the “Data Controller” or “Telepass”).

The Data Controller has appointed a data protection officer (“Data Protection Officer” or “DPO”), who can be contacted by email at the address DPO@telepass.com or by writing to: Responsabile per la protezione dei dati - Data Protection Officer (DPO) c/o Telepass S.p.A., Via Laurentina, 449, 00142 – Rome (RM).

In relation to use of the APP, Telepass will process the following Data:

  • OBU_ ID (serial number of the Telepass company device and related OK KO status…)
  • active services
  • the licence plate number and the licence plate nationality associated with the Telepass device
  • European Emission Class
  • Tractor weight
  • the axles and weight of the means of transport
  • PAN= Payment Account Number (a code that identifies the business payment method)

Your data is necessary to provide Telepass services via the APP to you.

The legal basis of the processing of Data for the aforesaid purpose is represented by the performance of the agreement pursuant to article 6, pargraph 1, letter b), GDPR.

In any case, we clarify that the conferral of your Data is voluntary; nevertheless, should you refuse to provide them, it will become impossible for the Data Controller to guarantee you the enjoyment of Telepass services via the APP.

We remind you, moreover, that the data collected may be processed in an aggregated form for statistical purposes and purposes of technical analysis/improvement of the APP on the basis of the legitimate interest of Telepass to improve its services.

Where applicable, your Data may be processed for indirect marketing and profiling purposes whenever you have positively expressed your consent during the signing of the agreement with Telepass and throughout its duration. We remind you, finally, that in any moment and without expense you can modify your privacy preferences directly from your personal area- Privacy section- in our mobile application or by writing to the email address privacy@telepass.com.

Where applicable, Telepass may also process your Data on the basis of its legitimate interest - to send promotional communications regarding products and/or services similar to those you have already requested and/or approved through signature. However, you have the right to refuse to receive these communications by clicking on the opt-out link inserted at the foot of each of them or by writing to the email address privacy@telepass.com.

Your data is kept exclusively in the APP and no other form of distributing it is established.

Telepass will process your data for the time strictly necessary for achieving the purposes previously indicated and described.

During the period in which Telepass is in possession or processes your Data, you, as data subject, may, in any moment, obtain, in the cases provided for by law, access to your personal data or their rectification or cancellation or the limitation of their processing, or object to their processing (Art. 15 and following articles GDPR) by writing to the email address privacy@telepass.com or contacting the DPO at the addresses indicated in the previous paragraph 2. If you believe that the processing of your personal data has violated the terms of the GDPR, you have the right to make a complaint to the Data Protection Authority, as established by Art. 77 of the Regulation itself, or to appeal to the appropriate legal authorities (Art. 79 of the Regulation).
